Mastercard against Nike

Mastercard Inc. has accused Nike Inc. of encouraging technology talent – a scarce resource nowadays – to leave their current employer and move to Nike. This was apparently done via Mastercard ex senior engineering manager and ex information security officer, who both work for Nike now.

Following the breach in security at Target Corp. and Home Depot Inc. most companies are trying to take their security game to a next level and for that they need highly qualified people. Mastercard stated that this is a fast growing, rapidly changing field and talent is scarce and in very high demand. It’s clear that this statement is true seeing how jobs in this domain have increased by 74% from in only 6 years – 2007 to 2013.

Mastercard claims that Nike is using the two former employees to encourage other Mastercard people to join them. This would prove to be disloyal competition and a breach of contract from the two former employees, whom are being sued together with their employer for breach of contract. For that Mastercard is requesting that a $5 million compensation is paid and that Nike is barred from soliciting Mastercard employees. The complaint was filed on January 8 at the court in White Plains, NY.

KeJuan Wilkins – current spokesperson for Nike – has stated that these complains have been investigated and they are of no merit. He has continued by saying that their employees have not acted inappropriately and therefore all charges should be dropped. However the case I still ongoing and the result will be something to look forward to.
